1. Acceptance of terms
By accessing or using SwoopForm ("the Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of the Service, including visitors, registered users, and paying customers.
If you are using SwoopForm on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Description of service
SwoopForm is an online survey platform that allows users to create surveys, collect responses, and analyse data. The Service includes features such as logic branching, quiz scoring, Google Sheets integration, and response analytics.
We reserve the right to modify, suspend or discontinue any part of the Service at any time with reasonable notice.
3. Account registration
To use most features of SwoopForm, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorised use of your account
- Be responsible for all activities that occur under your account
You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent.
4. Acceptable use
You agree not to use SwoopForm to:
- Create surveys that collect data illegally or without proper consent
- Distribute spam, phishing, or deceptive content
- Collect sensitive personal information (such as passwords, financial data) without appropriate safeguards
- Harass, abuse or harm others
- Violate any applicable laws or regulations, including India's Information Technology Act
- Infringe on intellectual property rights
- Attempt to gain unauthorised access to our systems
- Use the service for any illegal purpose
We reserve the right to suspend or terminate accounts that violate these terms without notice.
5. Your content
You retain ownership of all content you create on SwoopForm, including surveys, questions, and responses collected. By using SwoopForm, you grant us a limited licence to store, process and display your content solely for the purpose of providing the Service to you.
You are solely responsible for the content of your surveys and for ensuring you have the right to collect responses from your respondents, including obtaining any necessary consents under applicable data protection laws.
We do not claim ownership of your survey data or responses. Survey responses belong to you.
6. Plans and payments
SwoopForm offers both free and paid plans. Paid plans are billed monthly. By subscribing to a paid plan, you agree to pay the applicable fees.
- All prices are in Indian Rupees (₹) and include applicable taxes
- Subscriptions auto-renew unless cancelled before the renewal date
- We offer a 7-day refund policy on all paid plans
- Downgrades take effect at the end of the current billing period
We reserve the right to change our pricing with 30 days notice. Continued use after the notice period constitutes acceptance of the new pricing.
7. Verified plans (Student/Educator and NGO)
We offer free unlimited plans to verified students, educators and non-profit organisations. To receive verification:
- You must provide accurate proof of eligibility (student ID, staff ID, or organisation registration)
- Providing false information to obtain verification is a violation of these Terms
- We reserve the right to revoke verification if eligibility criteria are no longer met
- Verified plans are non-transferable and are for the named individual or organisation only
8. Termination
You may terminate your account at any time by going to Settings → Danger zone → Delete account. Upon termination, your data will be permanently deleted within 30 days.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will provide reasonable notice where possible.
9. Disclaimers
SwoopForm is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
We are not responsible for the content of surveys created by users or the accuracy of data collected through those surveys.
10. Limitation of liability
To the maximum extent permitted by applicable law, SwoopForm shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or ₹1,000, whichever is greater.
11. Governing law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of SwoopForm shall be subject to the exclusive jurisdiction of the courts in India.
